Rejecting Your Child’s IEP

In an ideal world, you and the school department will be in complete agreement about what your child needs to succeed…. But, lets get back into the real world for a minute. The IEP proposed by the school district may not include everything that your child needs. What do you do? Most parents will reject the IEP. This is a mistake! Now before you yell at me, I don’t mean that you should accept the IEP as written, what I mean is there is a right way to reject the IEP. You must reject only the parts that you don’t agree with and/or the parts that are missing. Well that sounds easy, but what should it look like?

Did you know that if you don’t write the rejection the right way, your child could lose precious time by not getting some of the services that they need? What about when the school department won’t give you a placement or a program until you sign? How do you reject something that isn’t there?

How to draft your rejection of the IEP?

  1. Write it like you would write a letter
  2. Use headers and sections to identify each area that you are rejecting
  3. Indicate what you want in the section so that you would accept it
  4. For components that are missing, ‘I reject the missing component/service/program of the IEP…..’
  5. To ensure that the parts of the IEP that are not rejected are provided to your child, always use this final statement, ‘Notwithstanding this rejection, all other parts of the IEP not rejected, should be considered accepted and should be implemented immediately’
  6. Always request a meeting to discuss the rejected portions of the IEP
  7. Make sure that you have some documentation or data to support what and why you are rejecting

You want your child to have the best available to them for their education. Your child only has one chance to get an education. When you are in High School, you can’t go back to elementary school and do things over again. The inflation rate of college education has always been a source of great anxiety and tension. This problem was partially resolved with the introduction of new education laws. These laws were introduced as a part of the Educational Plan of 2002, under Section 529 of the Internal Revenue Code. This is actually an amended law of the Educational Savings Plan of 1996. Leaving aside only a few states, you will find that this plan has been implemented in most of the states of U.S.

In California, it is also known as the California 529 College Savings Plan. The 529 college plan is much better than the Coverdell Education Savings Accounts. This plan has flexibility and many options to save on taxes. The percentage of tax incurred upon the saved amount – if withdrawn without expending on the purposes of education – is low. So you can always receive a good percentage of the money back on the saved amount.

The specific laws and the type of plans implemented (there are two different type plans) depend mostly on the enacted legislation of each state that administers them. Each state has been given the freedom to impose their own set of applicable laws, rules, and regulations, as long as they keep all the basic federal laws intact.

One of the more basic precepts of the 529 laws expresses the idea that the savings account can be contributed to by any person besides parents; like grandparents, relatives, or even parent’s friends. And in California, you’ll find both types of 529 plans; the Prepaid Plan and the Savings Plan. Among these, the more popular for Californians is the Savings Plan, which even has a growth provision that compensates for market inflation. The tax deduction scheme applicable to 529 laws in California is per the Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA). This legislation has provided income tax relief for “529 California”.

So, you’ll be able to implement a very safe, flexible savings scheme – with complete power of attorney to yourself – when participating in either type of these plans. And if you compare prices and benefits of the 529 laws between other states, you’ll find that the typical Californian enjoys more flexibility and tax benefits than any other.

Some Benefits Of The 529 California College Savings PlanFirst, you have choice: you can choose which type of plan to implement; the prepaid or the savings plan. Most states don’t prefer either one, and allow for both.

Secondly, some plans are state sponsored and some are privately sponsored. Even More Benefits from the California 529 plans4) Under this scheme of investing, the earnings from the savings are exempted from tax by the California Franchise Tax Board. So the distributions/contributions towards these funds are non-taxable, issued under certain conditions.

5) A minimum tax is levied on the total amount after maturity; that is, once the child starts into their college days. The actual tax is attached to the beneficiary’s Tax ID number. The exact amount and/or percentage of tax imposed on the funds depend on the tax laws and rules for that specific fiscal year’s budget.

6) You can invest in a fund to a maximum of ,000 for individuals and 0,000 for couples in any given year — without paying any gift taxes. In other words, the gifted amount is tax-exempt. This is a pretty strict ruling here, as the rule states that in the next five years, you cannot gift any more money to the beneficiary. Any gifts or contributions exceeding these amounts per each individual/couple will be taxed as per the California state tax rules.

Precautions while signing up for a new accountSome of the privately sponsored savings accounts have hidden charges, like; maintenance charges, program management fees, and other expenses attached to the underlying savings. These charges can be quite high in plans run by mutual fund companies, banks, or colleges. So you must read all the terms and conditions and fully understand these private plans before opening an account. For these reasons, many people prefer the state-sponsored programs over the private ones, which are simple and without any hidden charges.

One of the most controversial education issues today is the continuing decline in student learning standards at state schools throughout Australia, which is an issue of concern to both the public and the government. Hardly an election, be it State or Federal, goes past without the education band wagon being wheeled out, with promises of reform and greater spending to cure the problem.

Yet the problem persists despite a myriad of “solutions” being applied ranging from increased spending, shifting the focus onto e-learning and various curriculum and assessment frameworks.

Why is this problem so persistent? Despite intermittent efforts by the media to make teachers the scapegoat for the drop in standards, the blame lies neither with them nor with the students involved. At present, students can only be kept from progressing to the next year level if the parents of the student give permission. This sounds fine in theory, but in reality this permission is rarely if ever given. In the ten years I have worked as a teacher in Australian government schools, I have only seen one case of this.

This means that students are promoted to the next year level regardless of their skill level. The students are aware of this and as a result the completion of set work in the classroom has become optional. It is worth noting that private schools are not subject to this ridiculous situation.

Since there are no standards for moving up to the next year there are many students at any given year level that are well below the expected standard. This not only increases the workload of the teacher taking the class, but also diminishes the learning opportunities of those students who are interested in the work.

Behavioural issues go hand in hand with a poor skill level in a subject, as the student who is behind the expected level is frustrated by work they do not understand due to not having a good grounding in the subject from previous years.

Various solutions to these problems have been put forward including individual learning plans, open classrooms, task based learning and assessment, the list goes on and on. Most of these so-called solutions mean endless work for the teacher while producing no noticable improvement in student outcomes. But the fact remains that none of these reforms address the basic problem of students not being required to pass to a specified standard. There will be no significant improvement in student academic achievement in core subjects such as English, Math and Science until minimum pass standards are re-introduced. Everything else is simply rearranging deck chairs on the Titanic.
