When and How to Reject your IEP

Rejecting Your Child’s IEP

In an ideal world, you and the school department will be in complete agreement about what your child needs to succeed…. But, lets get back into the real world for a minute. The IEP proposed by the school district may not include everything that your child needs. What do you do? Most parents will reject the IEP. This is a mistake! Now before you yell at me, I don’t mean that you should accept the IEP as written, what I mean is there is a right way to reject the IEP. You must reject only the parts that you don’t agree with and/or the parts that are missing. Well that sounds easy, but what should it look like?

Did you know that if you don’t write the rejection the right way, your child could lose precious time by not getting some of the services that they need? What about when the school department won’t give you a placement or a program until you sign? How do you reject something that isn’t there?

How to draft your rejection of the IEP?

  1. Write it like you would write a letter
  2. Use headers and sections to identify each area that you are rejecting
  3. Indicate what you want in the section so that you would accept it
  4. For components that are missing, ‘I reject the missing component/service/program of the IEP…..’
  5. To ensure that the parts of the IEP that are not rejected are provided to your child, always use this final statement, ‘Notwithstanding this rejection, all other parts of the IEP not rejected, should be considered accepted and should be implemented immediately’
  6. Always request a meeting to discuss the rejected portions of the IEP
  7. Make sure that you have some documentation or data to support what and why you are rejecting

Get some professional help

Talk to a special education advocate or an attorney to see if you may need some professional help. There are many resources available so that you don’t have to go it alone. You want your child to have the best available to them for their education. Your child only has one chance to get an education. When you are in High School, you can’t go back to elementary school and do things over again. If your child is in High School, you can’t go back to school once you graduate, so make the most of the time you have now.

A Spanish version ofTAAS is available for students in grades three through six.

The second component of the assessment program, which has been in place since 2000, is called the Reading Proficiency Tests in English (RPTE). These tests are designed to be used with English-language learners to monimr their progress in learning to read and understand English. The tests contain reading selections and test questions divided into three levels of reading proficiency levels (beginning, intermediate, and advanced). English-language learners in grades three through twelve are required to take the RPTE until they achieve the advanced-level rating.

The State-Developed Alternative Assessment (SDAA), designed for special education students in grades three through eight, is the third component of the assessment system. Comprising tests in reading, writing, and mathematics, the SDAA is intended for students with disabilities who receive instruction in the state curriculum but for whom TAAS is an inappropriate measure of their academic progress, even when allowable accommodations are provided. The baseline year for the SDAA was 2000.

Stolp next described Texas’ accommodation policies. Accommodation decisions are made on an individual basis, and they take into consideration the student’s individual needs and the modifications students routinely receive in classroom instruction. Accommodations are available to all students in Texas, including general education students. For students receiving special education services, all accommodations must be documented in the student’s IEP. Accommodations must also be documented for the students served under Section 504 of the Rehabilitation Act of 1973. General education students can receive accommodations as provided to them in the classroom; for these students documentation is not required. The “bottom line” criterion, however, is that the accommodation should not cause test results to be invalid.

Stolp noted that allowable and nonallowable accommodations differ for the various assessment programs. For TAAS, allowable accommodations include oral administration in mathematics, social studies, and science; large-print and Braille test booklets; individual administration; dictating or typewriting responses to the writing test; recording answers on the test booklet; and orally responding to test items. Nonallowable accommodations include reading assistance on the writing and reading tests, use of a calculator or slide rule, use of English-language or foreign-language reference materials, and translation of test items. Braille is available for TAAS and for most of the SDAA. Stolp indicated that statewide, regional, district, and student test results are reported for each assessment program for each administration. Results for students using allowable accommodations are aggregated with the test results for all students. Results are disaggregated by language status (limited English proficient versus non-English proficient) and by special education status.

Early intervention gives your infant/child a daily educational routine in a “natural environment” setting long before most typical children even realize school exists. Your child then has a step up to what will be their ongoing path to learning. They’re in the school system discovering ways to be comfortable with therapy, therapists, teachers, class mates, their own individual capabilities and developing positive social skills which will carry them throughout their life. Doesn’t this seem a wise choice even for typically developing children?

Can I find a program that will put my child’s needs first…? … An environment which will accommodate her interests? … A school where teachers will patiently guide him to succeed and whom will celebrate even her seemingly smallest achievements? You can…! It’s time to look at IDEA, The Individuals with Disabilities Act.

 

The Individuals with Disabilities Act (amended 2004)

What is it?

IDEA is the United States law that provisions services and support to children with disabilities. It governs states and public agencies that provide early intervention, special education and related services to children of the United States. Eligible children must be provided services in the least restrictive environment. (In 2004 President Bush signed legislation reauthorizing IDEA)

How Does IDEA Apply to My Child?

Statute (P.L. 108-446) Part C, (PDF) contains state requirements regarding  early intervention. Evaluations and assessments are given at no charge to parents of eligible children. An IFSP, Individualized Family Service Plan (a written legal document containing an individuals plan of intervention) is created for an eligible child.

Eligibility is determined at a state to state level, although basic requirements for eligibility include that the child must reside in the state where services are to be received and must meet state qualifications regarding the degree of developmental delay which may not be limited to communication, social and emotional, vision, hearing, motor skills, adaptive and cognitive development.

Valuable Ways You Can Help Your Child Succeed in School

You can help your child obtain a quality education regardless of his or her ability or the conditions of his/her life and yours.  Here are some words of wisdom for both regular and special education parents, some of which you might have heard before, but most of these deserve repeating.  Although this article emphasizes the needs of special child who is often misunderstood, the suggestions apply to all children so that they can receive the best education.

1.     Check your teacher’s credentials.  There are websites where you can actually go and look up a teachers record of experience and education.  You can also politely and directly ask the teacher to give you specifics regarding teacher preparation, values and educational orientation and beliefs.  Also recognize that inexperienced teachers are under incredible stress.    Patience and understanding become particularly critical when this occurs, but recognize that the inexperienced, alternatively prepared individual may just turn out to be the best educator you could find.  Encouragement and involvement will do a lot to support both teacher and your child.

2.     If you move to a different school district and your child has an IEP or 504 plan, that is a large or slight disability, get a signed copy of the records before you leave.  There were stories about special needs children who were misplaced following Hurricane Katrina, so it’s a good idea to have the right paper work done and available.

3.    If you suspect your child has a disability, have a conference with the teacher in the first month of school.  He or she is supposed to observe the student, try some basic accommodations and, if those don’t work, a referral can be made within 30 days.  It is important that a child be evaluated before October 1st so that the school can get the extra money for children with disabilities if qualified.  

4.    Don’t let educational politics dictate your child’s education.  Some folks in education constantly complain, for example, that there are too many African American boys in special education.  Many of these boys probably just need another teacher with a high tolerance for physical activity, but others have disabilities that do not show up until they are expected to learn to read.  Your child needs an education tailored to his or her needs.  There is too much fitting the child to the program instead of the program to the child these days.  While parents may protest special education assignment, particularly when social disadvantage is the particular problem, some children do need intensive and specialized instruction and benefit from it.  

5.    If your child is a fidgeter, visit a doctor to see if medication is in order. If the child does not need the medicine, there will be no improvement if he or she takes it.  If the child does, you will notice less fidgeting and better concentration in a few days.  ADD and ADHD are real disabilities that sometimes need to be treated with real medicine.  This is another area wherein politicians whine about “medicating” children.  But if your child had diabetes you would not deny her insulin, would you?  There are numerous contradictions and unanswered questions in this area, but don’t rush to judgment.

6.    If your child has a hidden problem such as pants wetting or an allergy, be sure, the school knows. You need orders from a physician for a school to make proper accommodations.  The school nurse will develop a nursing plan for children with physical disabilities involving health considerations, and these will involve parent and teacher involvement so that there is a plan in place in the event of an emergency.   Plans between teacher and parent have to be made in order to prevent mishaps and misunderstandings.   Some of these plans may involve the school health officials and some may just involve an informal, but important, understanding that comes from interaction of teachers and parents.  Appropriate accommodations, however, need to be made in the event a child has special needs.

7.    If the school says the child needs help, be cooperative but learn your rights.  Listen and have input.  Make sure you know and understand what is going on. Ask all the questions you need to even if you spend all day with the special education or curriculum coordinator. This is part of the job of the specialist, to listen to parent concerns.  Special education is a second chance for success.  It is not punishment unless someone makes it so.  

Now here are some tips that apply to all students.

1.    Try to collect the supplies your child needs so he has them on the first day.  Civic and community groups often help with this.
2.    Don’t put a Pre-K or Kindergarten child in clothing with fasteners. Elastic waists are best.  A small child who needs to use the bathroom has to go then!  Little girls can be saved by wearing jumpers or dresses. If a child is just turning 4 when he starts Pre-K you might have to fine tune toilet training.  If he still has accidents, quietly take an extra set of clothing that stays at school.  Accidents in small children are the result of physical immaturity, not behavior problems. Teachers who chastise children for accidents or who won’t let them use the bathroom should be reported.
3.    Provide your child with home training so that he knows how to speak respectfully to adults, wait his turn and not constantly demand attention.  Don’t condone fighting.   A good school will also teach conflict resolution skills. Bullying is a crime.
4.    Listen to your child’s concerns.  If a child tells you about something ugly the teacher does several times, it’s time for a conference.  Most teachers are quality, caring professionals, but a few are incompetent, mean or mentally ill.  Do not go behind the teacher’s back to the principal or school board without having conferencing with the teacher first.    .
5.    Make sure your child has a quiet, comfortable place to do homework and that he has time to play and is not hungry.  If you live with relatives, in some small or cramped condition, go to the public library, a park or other well-lighted public place.  By providing a pleasant place to do homework you are telling your child that school is important.
6.    If you can afford it, get a computer and Internet access.  Put it where you can see what the child is doing and don’t let the child play video games until homework is done.  These days many teachers have school websites which the parents can use to keep up with school events.  If you can’t afford one, there are computers available at libraries.  Librarians can help both you and your child in opening up the wonderful world that the use of computers can bring to the learning experience.  
7.    Read to your child every day at least through elementary school.  Bedtime stories are a parent – child interaction that remains a valuable tradition that brings parent and child together, reinforce language skills and that continues to endure as a special time for everyone involved.
8.    Give your child community experiences.  Go to parades, festivals and the library.  You don’t have to spend money to be involved with your child in ways that prepare him or her for education and for life.  A child who has been outside of the local community, who has experienced seeing many places and doing many things,  has experiences to write and talk about with others. Don’t always do the grocery shopping while your child is at school.  The neighborhood store can be a place to learn.  For example,let the child have the experience of handling the money or putting the EBT card in the machine.  Participate in faith -based programs.  Church attendance and involvement can provide children with positive experiences and the development of good social skills and values.

To summarize, all of these suggestions help reinforce that you respect the child.  By doing many of these things you are teaching the child to respect others.  While you’re working with the child, you will make mistakes.  Don’t be afraid to admit them and apologize.  Be an example to the child as you want the child to be, and he or she will then be more likely to adopt sound moral values.   School is a partnership with parents to develop functional adults.   It needs the input of both teacher and parent for the child to succeed in school.

Tindal and his colleagues also studied the accommodation of allowing students to use word processors to respond to essay questions instead of handwriting responses. One study (Hollenbeck, Tindal, Stieber, and Harniss, 1999) involved 80 middle school students who, as part of Oregon’s statewide assessment, were given three days to compose a handwritten response to a writing assignment. Each handwritten response was transcribed into a word-processed essay, and no changes were made to correct for errors. Both the handwritten and the word-processed versions of each essay was scored during separate scoring sessions, with each response scored on six traits.

Analyses showed that for five of the six traits, the mean scores for handwritten compositions were higher than the means for the word-processed compositions, suggesting that there were differences in the ways scorers rated essays in the two response modes. For three of the traits (Ideas and Content, Organization, and Conventions), the differences between means were statistically significant. Tindall cautioned, however, that because the study participants were predominantly general education students, the findings may not generalize to students with disabilities.

Tindal and his colleagues have also conducted factor analyses” to study the factor structure of word-processed and handwritten response formats (Helwig, Stieber, Tindal, Hollenbeck, Heath, and Almond, 1999). For this study, 117 eighth graders (10 of whom were special education students) handwrote compositions for the Oregon statewide assessment in February, which were transcribed to word-processed essays prior to scoring. In May the same students responded to a second writing assessment, this time preparing their responses via computer. Both sets of essays were scored on the six traits. The researchers conducted factor analyses on the sets ofscores for each response format.

The factor analyses showed that when only handwritten or only wordprocessed papers were analyzed, a single factor was identified (all traits loaded on a single factor). When data from the two writing methods were combined, two factors emerged. One factor included the trait scores based on the word processed response, while the other included all the trait scores based on the handwritten response. Correlations between the trait scores for the different response formats were weak, even for scores on common traits. The researchers concluded from these findings that handwritten and word-processed compositions demonstrate different skills and are judged differently by scorers.

In another study, Tindal and his colleagues examined the effects of providing a simplified-language version of a mathematics test to students with learning disabilities (Tindal, Anderson, Helwig, Miller, and Glasgow, 1999). Study participants were 48 seventh graders-two groups of general education students enrolled in lower mathematics classes (16 per group) and a third group of 16 students with learning disabilities who had IEPs in reading. Two test forms were developed, one consisting of items in their original form and one with the simplified items. The simplification process involved replacing indirect sentences with direct sentences; reducing the number of words in the problem; replacing passive voice with active voice; removing noun phrases and conditional clauses; replacing complex vocabulary with simpler, shorter words; and removing extraneous information.

Analyses revealed that the simplification had almost no effect on test scores; that is, students who were low readers but did not have an identified disability and those with disabilities performed equally well in either condition. Furthermore, the researchers found that 10 of the items were more difficult in their simplified form than in their original form. Tindal pointed out that the study had several limitations. Specifically, the sample size was small and the subjects were poor readers and students with disabilities, not English-language learners. For this part, learning a foreign language needs a leaning tools, many people choose Rosetta Stone Arabic and Rosetta Stone Chinese to learn Arabic and Chinese. He believes that the results are not conclusive and that the use of language simplification as an accommodation for students with learning disabilities needs further study.
